Terms of Use
These Terms of Use (“Terms”) govern your access to and use of Electo (the “Service”), a QR code creation, management and analytics platform operated by Electo (“Electo”, “we”, “us” or “our”). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. The Service
Electo lets you generate, style, manage and track QR codes, including static codes and dynamic codes that resolve through a redirect we host. Features and limits depend on the plan you choose and may change over time as the Service evolves.
2. Your account
You need an account to download files, save codes or access analytics. You must provide accurate information, keep your credentials confidential and are responsible for all activity under your account. You must be at least 16 years old, or the age of digital consent in your country, to register. Notify us promptly of any unauthorised use.
3. Acceptable use
You agree not to use the Service to create, distribute or link QR codes that:
- point to malware, phishing pages, fraudulent or deceptive content;
- infringe the intellectual property, privacy or other rights of others;
- contain or promote illegal, hateful, harassing or abusive material;
- distribute unsolicited advertising or spam; or
- attempt to disrupt, overload, reverse-engineer or gain unauthorised access to the Service or its infrastructure.
We may suspend or remove any code, content or account that we reasonably believe violates these Terms.
4. Your content
You retain ownership of the data, links, text, images and other content you add to your QR codes (“Your Content”). You grant us a limited licence to host, store, process and display Your Content solely to operate and provide the Service to you. You are solely responsible for Your Content and for the destinations your codes point to, and you confirm you have the rights needed to use them.
5. Plans, billing and cancellation
The Service offers a free plan and paid plans. Paid plans are billed in advance for the billing period you select and, unless stated otherwise, renew automatically until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period and, except where required by law, fees already paid are non-refundable. We may change pricing on a prospective basis with reasonable notice.
6. Intellectual property
The Service, including its software, design, branding and the “Electo” name and logo, is owned by Electo and protected by intellectual property laws. These Terms do not grant you any right to use our branding except as necessary to use the Service as intended.
7. Availability and changes
We work to keep the Service available and reliable, but it is provided on an “as is” and “as available” basis. We may add, modify, suspend or discontinue features, and may perform maintenance that temporarily affects availability.
8. Disclaimer of warranties
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, or that any QR code will scan correctly on every device.
9. Limitation of liability
To the fullest extent permitted by law, Electo will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill. Our total liability arising out of or relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim.
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if needed to protect the Service or other users. On termination, your right to use the Service ends; sections that by their nature should survive will survive.
11. Governing law
These Terms are governed by the laws of the jurisdiction in which Electo is established, without regard to conflict-of-law rules. Mandatory consumer protections of your country of residence still apply where relevant.
12. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will update the “Last updated” date above and, where appropriate, notify you. Continued use of the Service after changes take effect means you accept the revised Terms.
